I suppose one method of getting around it is even following comment 31 and making a wav file yourself if aac audio doesn't work as rariss suggested.

Rariss converting the files to .acc brings the same isuee

and i can see why someone came to that conclusion.. its because the default ringtones are that format(.acc or ADTS Audio)
but they are considerately smaller files.

well im off on my way to work so i will tinker with fixing this issue when i get home if anyone finds a solution please feel free to enlighten.. thanks

mp3 to wav.
I replaced the automatically generated wav file with another 2 ch, 44100 Hz,

i also have this problem, it only seems to happen with mp3

ah well,
well then the only other options i can think of would be to
-try Blaizzen's suggestion of converting the file to .wav yourself since this is the way the phone handles ringtones at the moment
-lower the bitrate of the mp3 or aac? (but this is a shot in the dark)
